Both parties understood the alterations would require additional work, and as a result the construction company was adequately paid for the work, attorneys for the water district claimed.
“[The district] made every effort to negotiate in good faith all change-order requests made by [the] plaintiffs,” according to the court filing.
Water district officials also claim the construction company failed to meet the conditions of an encroachment permit, which the Los Angeles County Department of Public Works issued for repaving the road.
