PASADENA — County prosecutors will appeal a court decision to dismiss the murder charges against the driver of a big rig that barreled through the Foothill Boulevard intersection of Angeles Crest Highway in April, killing a 12-year-old and her father, officials said.
The charges against 44-year-old Marcos Barbosa Costa, who also holds a Brazilian passport, were dismissed Oct. 9 after Los Angeles County Superior Court Judge Lisa B. Lench said the circumstances of the crash did not rise to the level of murder.
The prosecution announced at Friday’s pretrial that it would file an appeal of that decision next week, said Jane Robison, spokeswoman for the district attorney’s office.
