A court hearing was delayed Tuesday for the truck driver charged with murder after his car carrier veered out of control on Angeles Crest Highway last year killing a Palmdale man and his daughter.
Murder charges against Marcos Barbosa Costa, 44, were reinstated April 6 by a state appeals court panel, which ruled that Costa was aware of the risk involved when he descended the steep mountain pass. The ruling reversed a lower-court decision to throw out the murder charges.
On April 1, 2009, Costa drove a car carrier southbound on Angeles Crest Highway.
As the truck approached La Cañada Flintridge, it lost its brakes, gained speed and smashed through a busy intersection before stopping in a bookstore. Jorge Angel Posca, 58, and his daughter, Angelina, 12, both of Palmdale, were killed.
